Identity Fraud

Massachusetts General Laws Chapter 266, Section 37E(b), makes criminal the act of posing as another person without the express authorization of that person and, with the intent to defraud, uses that person’s personal identifying information to obtain or attempt to obtain money, credit or anything of value, an identification card or to harass another.

The crime of Identity Fraud is punishable in Massachusetts with imprisonment for up to 2.5 years, a fine of up to $5,000, and restitution of any financial loss.

In order to be convicted of the crime of Identity Fraud, the prosecutor would be required to prove, beyond a reasonable doubt:
  1. That the defendant posed as another person;
  2. That the defendant did so without that person’s express authorization;
  3. That he/she used that person’s identifying information to obtain or attempt to obtain money, credit or some other thing of value; an identification card or other evidence of that person’s identity; or to harass another person; and
  4. That the defendant did so with the intent to defraud.
For purposes of the crime of Identity Fraud, to “pose” as another person means to falsely represent oneself, directly or indirectly, as another person.
