Human Trafficking for Sexual Servitude

The Massachusetts Sex Crime of Human Trafficking for Sexual Servitude is defined as knowingly subjecting or attempting to subject another, by any means, to engage in commercial sexual activity, a sexually explicit performance or for the production of unlawful pornography; or benefits financially as a result of such.

Massachusetts General Laws chapter 265, section 50(a) punishes the crime of Human Trafficking for Sexual Servitude by imprisonment for not less than 5 years and up to 20 years in state prison.

Chapter 265, section 50(b), which proscribes Human Trafficking of Persons for Sexual Servitude of persons under the age of 18, punishes those convicted of this section with imprisonment for not less than 5 years and up to life in state prison.

Aside from the potential for imprisonment, a conviction for the sex crime of Human Trafficking for Sexual Servitude will also subject the defendant to Sex Offender Registration; will require him/her to submit a DNA sample to the Massachusetts DNA Database; and may also serve as a predicate sex offense for civil commitment as a “sexually dangerous person” pursuant to Massachusetts General Laws Chapter 123A, Sections 1-15.
