Aggravated Assault & Battery

In Massachusetts, an Assault & Battery that is committed under certain circumstances will be considered Aggravated, and the punishment for such an Aggravated Assault & Battery is up to 5 years in state prison.

An Aggravated Assault & Battery is defined as an intentional touching, however slight, that is harmful or offensive and committed without justification or excuse, and:

Results in serious bodily injury;
Is committed upon another who is pregnant at the time; or
Is committed on someone who the person knows has an outstanding Restraining Order against the defendant.

For the purposes of an Aggravated Assault & Battery, ‘serious bodily injury’ means bodily injury that results in a permanent disfigurement, loss or impairment of a bodily function or organ, or a substantial risk of death.
