Commonwealth v. L.W. – Suffolk Superior Court – Sex Crimes Charges
The client was charged out of Suffolk Superior Court on Massachusetts Sex Crimes for allegedly sexually molesting a young girl over a period of years when she was between 9 and 12 years old. He was indicted by a Suffolk Grand Jury on 6 counts of Indecent Assault & Battery of a Child Under 14.
The victim, who lived in the same 3 family dwelling as the defendant’s mother and next door to the defendant, alleged that he touched her in various sexual ways over that period. The victim, however, did not tell anyone about the allegations until some time later, when she told some classmates at school. As such, there was no physical evidence and no other witnesses to corroborate the victim’s allegations.
The defense of this client focused on lack of opportunity, as some of the claims the victim made were questionable, both in location and otherwise. Additionally, Attorney Lefteris K. Travayiakis spoke with every possible witness who might remotely offer any insight to the allegations in an effort to uncover any motive to lie.
Meanwhile, the client had been held in custody on high bail since the inception of the case. Refusing to take any ‘deals’ offered by the government, he rejected an initial offer of 5-7 years in state prison; and then further rejected an offer of 2-3 years in state prison that was offered on the eve of trial.
On the day of trial, with several defense witnesses present in court, the prosecutor entered a ‘nolle pros’ and all Sex Crimes Charges of Indecent Assault & Battery on a Child Under 14 were DISMISSED.
