Enticement of a Child Under 16
The Massachusetts Sex Crime of Enticement of a Child Under 16 criminalizes the conduct of enticing a child under the age of 16 to enter, exit or remain in any vehicle, dwelling, building or other outdoor space with the intent that he or another person will commit certain other offenses, including the sex crimes of Indecent Assault & Battery; Rape; Rape of a Child; Assault With Intent to Commit Rape.
Notably, a person may also be charged with Enticement of a Child Under 16 even if the child/person is not 16 or younger. For purposes of this statute, it is sufficient if the person believes the child to be under 16. Police officers conducting a sting operation and posing as a child, for example, is sufficient to give rise to this charge.
Massachusetts General Laws chapter 265, section 26C(b), provides that the punishment for the sex crime of Enticing a Child Under 16 is imprisonment in state prison for up to 5 years; or commitment to the House of Corrections for up to 2.5 years.
As with many sex crimes, a conviction for the crime of Enticement of a Child Under 16 would trigger mandatory Sex Offender Registration; require the offender to submit a DNA sample to the DNA database; could result in a term of community parole supervision for life; and may also serve as a predicate sexual offense for civil commitment as a ‘sexually dangerous person’.
