The defendant was charged with Receiving Stolen Motor Vehicle, Negligent Operation of a Motor Vehicle, Leaving the Scene of Property Damage, and Failure to Stop for Police.
The Boston Police alleged that the car the defendant was driving was stolen, which is why he allegedly failed to stop for the police while leading them on a high-speed chase through various Dorchester neighborhoods, striking a number of parked cars along the way, and all while having two young children in the back seat of the car.
Despite testimony from Boston Police Officers that they recognized the defendant as the one who was driving because they were familiar with him from a previous ‘encounter,’ the Defendant maintained that he was only a passenger in the car. The real driver, he contended in his defense, had made his escape in the few seconds that the police had lost sight of the car.
At trial, the defense focused on the issue of mistaken Identification, and prosecutor’s own witnesses’ testimony, Attorney Travayiakis argued in his closing, only strengthened the defense.
After a jury trial, client was acquitted and found NOT GUILTY of all charges.
